北京时间2月28日下午5点，国际体育仲裁法庭（CAS）宣布了此前世界反兴奋剂机构（WADA）诉中国游泳运动员孙杨和国际泳联（FINA）一案的仲裁结果，从今天开始孙杨将被禁赛8年。

The Court of Arbitration for Sport (CAS) has handed down an eight-year ban to Chinese swimmer Sun Yang, who has been found guilty of breaking anti-doping regulations.

该禁令使得孙杨无缘今年的东京奥运会，也几乎断送了这位十一届世界游泳冠军的体育生涯。

The heavy ban rules Sun out of this year's Olympic Games in Tokyo and almost certainly ends the 11-time World Champion's professional swimming career.

孙杨是三届奥运游泳金牌的获得者，因其在2018年9月在中国的一次赛外兴奋剂检查中打碎了血样和尿样瓶子(暴力抗检)而被起诉。

The three-time Olympic gold medalist was accused of using a hammer to break a vial containing a blood sample during an out-of-competition drug test at his Chinese residence in September 2018.

此案由体育仲裁庭（CAS）由 由法官Franco Frattini（意大利）、主席Romano F. Subiotto（英国/比利时）、教授Philippe Sands（英国组成合议庭进行听证审理）。

CAS裁决中写到：CAS合议庭一致决定，该运动员违反了国际泳联规则中的2.5项条款（即违反兴奋剂控制）。

"The CAS Panel unanimously determined, to its comfortable satisfaction, that the Athlete violated Article 2.5 FINA DC (Tampering with any part of Doping Control)," a CAS statement read.

合议庭认为，兴奋剂检测人员的行为完全符合国际测试调查标准（ISTI)。尽管如孙杨所说，检测协议与国际测试调查标准（ISTI规定的不符，但是孙杨不能提供充分证据证明他有毁坏送检样本，拒绝兴奋剂检查的必要条件。

"In particular, the Panel found that the personnel in charge of the doping control completed with all applicable requirements as set out in the ISTI."

More specifically the Athlete failed to establish that he had a compelling justification to destroy his sample collection containers and forego the doping control when in his opinion the collection protocol was not in compliance with the ISTI."

Sample Collection Personnel shall have official documentation, provided by the Sample Collection Authority, evidencing their authority to collect a Sample from the Athlete, such as an authorisation letter from the Testing Authority. DCOs shall also carry complementary identification which includes their name and photograph (i.e., identification card from the Sample Collection Authority, driver’s licence, health card, passport or similar valid identification) and the expiry date of the identification.

采样人员（Sample Collection Personnel）需持有采样机构（Sample Collection Authority，本案中即IDTM）提供的官方文件，例如检测机构（Testing Authority, 本案中即FINA）的授权书，以证明（采样人员）具备从运动员采取样本的授权。主检官还需持有标明其名字、相片和有效日期的补充身份证明（例如采样机构提供的身份证件、驾驶证、健康卡、护照或类似的有效证件）

孙杨则坚称自己没有过错，对方没有出具合理的检测资质，其检测行为不合规。

Sun has maintained his innocence citing the tester's inability to present correct documentation to identify themselves as the reason for his actions.

在2018年11月上诉的国际泳联仲裁庭审中，孙杨发表如下意见：

”如果一个没有证件的检查官半夜来到你家说：‘我是警察，但是我没有证件。‘你们会如何反应？“

“If a policeman came to your house in the middle of the night and says, ‘I’m a policeman, but I don’t have any identification,’ how would you behave?” Sun said during his appeal before the Court of Arbitration back in November.

随后，国际泳联国际泳联反兴奋剂委员会作出决定：因WADA检测过程存在瑕疵，不对孙杨予以惩戒，也正因为这个决定，才导致WADA向国际体育仲裁庭提起诉讼。

Swimming's governing body FINA subsequently elected not to punish Sun after correct documentation protocol was not followed, which prompted WADA to launch its appeal to the CAS.

2019年11月15日，国际体育仲裁法庭在瑞士蒙特勒举行公开听证会，但因翻译问题，听证会不得不推迟到2020年。

Sun's initial hearing took place on November 15 but a number of translation issues saw it pushed back until early 2020.

早在2014年，孙杨曾因兴奋剂检测阳性被禁赛三个月，基于这个事实，合议庭才根据国际泳联规约的10.7.1条，对其之前存在过一次违反反兴奋剂规则（ADRV）的行为，故应对其处以自从次日起八年的禁赛期决定。

Sun was also issued a three-month ban in 2014 after testing positive trimetazidine, which at the time of testing was classed as a stimulant but has since been downgraded to a modulator of cardiac metabolism.

尽管根据国际体育仲裁法庭的规定，如果对此次裁决结果不满，孙杨可就非常有限范围的程序性问题向瑞士联邦最高法院提出上诉。但孙杨坚定表示他会上诉，要让更多的人知道真相。

When asked what his next steps will be following the verdict, Sun said he will "definitely" appeal the ruling.

"This is unfair. I firmly believe in my innocence," the 28-year-old Sun was quoted as telling Xinhua News Agency.

"I will definitely appeal to let more people know the truth."

Sun's participation in last year's World Championships was the subject of major upheaval, with Australian swimmer Mack Horton and Britain's Duncan Scott protested.

Horton refused to stand on the podium with the Chinese star, labeling him a "drug cheat" after he won the 200m freestyle final, in which Horton claimed a bronze medal. Meanwhile, Scott wouldn't shake hands with Sun after he claimed the 400m freestyle final.
